Aisling v. The cause of action for negligent misrepresentation was dismissed. At trial it was alleged that Donald Schell, was taking Paxil for two days before he committed the gruesome murders and suicide. Plaintiff's lawyers successfully argued that defendants failed to provide adequate warning label warning about possible violent reactions or suicide attempt from taking the drug. While the defense argue that the crimes were caused by his own state of depression.
Plaintiff's lawyers were able to show at trial that Paxil can cause some patients to become homicidal or suicidal. They further introduced evidence that the manufacture of Paxil had knowledge that its products could cause violent and suicidal tendencies. It turned out that the manufacture had internal studies that this was a real possibility in a small group of individuals.
After five hours of deliberation, the jury found that the manufacture of Paxil was 80% liable for the killing and that Schell was 20% at fault.
Restatement Section 402B
The Restatement (Second) of Torts, Section 402B, states, One engaged in the business of selling chattels who, by advertising, labels, or otherwise, makes to the public a misrepresentation of a material fact covering the character or quality of a chattel sold by him is subject to liability for physical harm to a consumer of the chattel sold by him is subject to liability for physical harm to a consumer of the chattel caused by justifiable reliance upon the misrepresentation, even though (a) it is not made fraudulently or negligently, and (b) the consumer has not brought the chattel from or entered into any contract relation with the seller.
